Terms of Service

1. Acceptance

By accessing or using The Coach OS ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

The Coach OS is a coaching practice management platform that provides client management, session intelligence, content generation, scheduling, billing, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or entity per account. Shared accounts are not permitted.
  • You are responsible for all activity that occurs under your account.

4. Your data

You retain ownership of all data you enter into the Service, including client information, session notes, frameworks, content, and form responses. We do not claim any intellectual property rights over your content.

You grant us a limited license to process, store, and transmit your data solely for the purpose of providing the Service. This includes sending your data to AI providers (Anthropic, OpenAI) for processing, and to integrated services you authorize (Stripe, Calendly, ActiveCampaign, Zapier, etc.).

5. Client data and responsibility

You are responsible for obtaining appropriate consent from your clients before entering their data into the Service. This includes informing them that:

  • Their session transcripts may be processed by AI to generate notes and insights.
  • Their contact information is stored in the platform.
  • They may receive communications via email, SMS, or the client portal.

The Coach OS provides tools to help you manage consent (client portal, notification preferences, data export, account deletion), but the legal responsibility for obtaining consent rests with you as the data controller.

6. Billing and refunds

  • Paid plans are billed monthly or annually via Stripe.
  • Founding member pricing is locked at the rate active at the time of first subscription for as long as the subscription remains active.
  • Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.
  • Downgrading to a lower plan takes effect at the next billing cycle.
  • We may change pricing for new subscribers with 30 days notice. Existing subscribers keep their locked rate.

7. Acceptable use

You may not:

  • Use the Service for any illegal purpose.
  • Attempt to access other users' accounts or data.
  • Use the API or integrations to send spam or unsolicited messages.
  • Reverse-engineer, decompile, or disassemble the Service.
  • Exceed reasonable usage limits or abuse API endpoints.
  • Resell access to the Service without written permission.

8. Third-party services

The Coach OS integrates with third-party services (Stripe, Calendly, ActiveCampaign, Zapier, Zoom, Fathom, Otter, Fireflies, Nylas, Twilio, Resend). Your use of these services is governed by their respective terms. We are not responsible for the availability, accuracy, or policies of third-party services.

9. AI-generated content

The Service uses AI to generate session notes, content, insights, and coaching suggestions. AI-generated content is provided as a starting point and should be reviewed before use. You are responsible for the accuracy and appropriateness of any content you send to clients, publish, or rely on for coaching decisions.

The Coach OS is not a licensed therapy, counseling, or medical service. AI-generated insights are not clinical diagnoses or treatment recommendations.

10. Limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your account at any time from Settings → Security → Delete Account. We may suspend or terminate your account if you violate these Terms, with notice where practicable.

Upon termination, your data will be permanently deleted within 30 days. You may export your data before terminating (Settings → Security → Export Your Data).

12. Governing law

These Terms are governed by the laws of the Republic of Cyprus. Any disputes will be resolved in the courts of Cyprus.

13. Changes

We may update these Terms from time to time. Significant changes will be communicated via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
